It wasn't self defense if he shot first, which he did.

He was also not legally allowed to carry that gun in the first place.

So not only was he in illegal possession of that weapon (a felony), he trafficked it across state lines (a felony), and used it to kill two people and wound a third (also felonies, and because he trafficked the gun across state lines, proves intent to kill).
