Not in this case. The entire Capitol was under siege. How many cops were ignored and then attacked just before Babbitt breached that window? Do you believe that anyone was confused about who the cops were? Do you believe that they had any intention of standing down because some cop identified him/herself?

That has nothing to do with their use of force policy. And as far as who was confused about who was a cop there? The guy that murdered Ashli was in plain clothes. No badges, nothing. In addition it does not matter if they had any intention of standing down. The LEO did not follow use of force policy. He did not identity himself, he did not command her to halt or stop. The chickenshit just hid behind a door and murdered her.
 
Agree. But if you pretend to be neutral, and view the videos from inside the chamber, you'll have to admit that nobody could tell what the mob had in mind. They were shouting about killing Pence, and looking for Pelosi. The sound of them crashing the doors was pretty moving.

No jury in the world would convict a cop of murder for shooting at Babbitt, given the evidence that directly preceded the event.

What the mob had in mind? They had working gallows, stun guns, pepper spray, baseball bats etc., not to mention zip-tie handcuffs.

The facts remain Babbitt was part of an Insurrection seeking to breakthrough a final blocked door of DCPD personnel protecting Congressional staff. Shooting one of the Insurrectionists is the next level of warning. Frankly, I would have emptied the magazine into 15 different targets at that point and have been justified to do so. If anything, the DCPD showed amazing restraint.
 
In a Qanon court perhaps. They didn't even charge the cop that shot that guy in the back as he seemed to be trying to get something from his car.

In a kangaroo court you mean. Just what democrats are turning this into. If he guy has nothing to hide and feels he was justified there should be no reason he should be afraid of going to court.

It is quite clear that LEO that shot Ashli did not give warning. At all. And showed restraint? Have you seen the videos? They were like the keystone cops.

A jury may get to decide that yet if Babbit’s family is successful.

Moreover, if their lawyer is smart he will go after Congress for lack of security. With adequate security there never would have been a need to shoot Babbitt or anyone else.
