Insurrection Committee's probable charges for Trump identified

While the DOJ pursues the rioters, the special House Jan. 6 Committee is separately collecting evidence to formulate a picture about how this all came together. And legal scholars say a strategy is taking shape—one that builds a case to criminally charge the former president.

“The DOJ and the committee are building a pyramid of guilt to get to the top. The more people who plead guilty, the more the top of the pyramid begins to take shape,” said Joshua E. Kastenberg, a professor at University of New Mexico’s law school.

Rep. Liz Cheney (R-WY), one of the two GOP members on the congressional panel investigating the insurrection, first drew attention to that possibility during a televised hearing last week. That’s when she made an obscure reference to “another key question before this committee: Did Donald Trump, through action or inaction, corruptly seek to obstruct or impede Congress’ official proceeding to count electoral votes?”

On Monday, The New York Times pushed that idea further when it revealed that the House committee investigating the insurrection is considering referring Trump to the Justice Department.

David Schultz, a law professor at the University of Minnesota, said congressional investigators could be building a case that Trump “aided and abetted” the rioters to interrupt the vote count. And Cheney’s statements, combined with the Justice Department’s aggressive use of this federal charge, hint at what might come.

“We are seeing a pattern of establishing an obstruction of justice that takes it up the food chain,” he said.

Never happen, at best, they will only lay down the case against Trump but not actually refer his name to the DOJ. If they did, the DOJ would find a way not to precede.

Too many precedents would be set, besides, the reality is Trump would litigate the hell out of it, delay and postpone, and cake walk it up to the SCOTUS. The jury the Committee needs to win over is the American citizenry, they are the ones that will decide Trump’s fate.

Well they better hurry up. They have about one more year before the committee gets dissolved and a new one begins to investigate Hunter Biden's laptop.

Hello reagansghost,

Best bet, the Committee will continue to investigate till say late Spring, spend the summer authoring a report, and in the Fall release the report. You are correct, given that the Trump team will litigate the hell everything and anything, the predicted GOP House majority will end it all

As I said above, the real jury is the citizenry, ultimately they will decide Trump’s fate, the Committee’s task is to author a detailed incriminating report that will silence the expected right wing political and media sources’ “alternative facts” criticism

Ultimately Trump belongs in prison. Time will tell if this administration is powerful enough to put him where he belongs.

The citizenry elected Biden and Biden appointed AG Garland. If the House committee refers criminal charges to the AG he must decide to pull the trigger or not. Technically all the House needs to do is send the referral over before any takeover by the loonies in 2022, it should be out of Congress' hands at that point.......Garland will be around until 2025

I don't know how else the citizenry can punish Trump w/o storming Mara Lago or occupying Trump Tower

So much for innocent until proven guilty. Archives is right, Trump will never be charged for anything related to January 6.

I don't think the Biden, nor Garland, understood nor wanted Garland to be another Billy Barr, the President's fixer

As I noted, the Committee needs to provide for the American people a detailed report on how and when Trump was involved, it has to be convincing enough to withstand the onslaught of attacks from the right and their media

Trump is never going to see the inside of a prison cell even though that's where he deserves to die. He should be held accountable, but he never has been so far in his miserable life. The sooner he dies or disappears or is forgotten we'll all be better off.
