The Trump-appointed Judge conceded to Trump's request for a Special Master....a Special Master chosen by Trump. Once the SM rules, my understanding is that the Judge will stand by it. She's already been overruled by a higher court at least once in this case. I strongly doubt she wants to take another public spanking by going against the law in favor of Trump.

this was a preliminary hearing, setting the agenda, forming the relevant issues and setting the burden of proof on each issue......it is not the final decision and the time for providing proof is still to come, not past......

His attorneys will not make any claim that he declassified them because that would be a lie and they would lose their license to practice. The DoJ has all the evidence they need to prove that as well as evidence that trump was told long ago by white house lawyers that it was illegal to have them.

But just for yuks, let’s say it’s true that Trump declassified much of what the FBI agents uncovered at Mar-a-Lago and that having done so could serve as his get-out-of-jail-free card. If that were the case, the ex-president and his legal team would have no problem telling the special master assigned to the case exactly which documents it applied to, right? Apparently, not so much. Possibly because—and we know this might come as a shock given that it’s about famously honest person Donald Trump—it’s a total lie.

The trumper likes to say that if they were not classified then everything is ok and that is bullshit, the documents did not belong to the ex-president and he was given ample opportunity to return them.

It is nothing but fucking stupid to think the supreme court is going to get involved if Trump is charged. The DoJ has all the proof they need to make this an open and shut case. Trump has not come up with a single reason why he had them and it is blatantly obvious he should not have had them. They can also prove he knew he had them when he should not and that he prevented them from taking many of them the first time the govt was at Mar a Lago retrieving them.

You are right that there was no reason for a special master other than to satisfy the ex presidents demands but you do need a judge to pass sentence after he is convicted. There is no question concerning his guilt. Even if all the evidence is thrown out we know he was guilty of the crime. Getting off on a technicality does not mean is was innocent.
