Since I don't advocate the death penalty, for the most part I would agree for equal treatment. Now if we still institutionalized those that were mentally dangerous to society the problem cases like this may not arise as much as they do today. But that's another story for another day.
De institutionalization was a mistake. I would be OK with moving the low risk offenders to community centered mental health facilities. But they shouldn't have let nearly ALL people out of institutions. And the community centered mental health facilities that were promised as an alternative to institutionalization never arose - they just kicked them out of the institutions and said to hell with it.
I still don't think a person with a serious mental health disease (like schizophrenia) should be treated the same as a person who's merely is merely predisposed to violence. They're two different types of offenders and need to be put into different systems. I think I confused things a bit back - I was going into hyperbole mode. Most people like this don't have a literal psychiatric illness, although they're obviously flawed in other respects.
