Tell me again why we should not have a death penalty

Death sentence for kids' killings 25 year ago

TUCSON - A Tucson man has been sentenced to die in the bludgeoning death of his girlfriend's two children more than 25 years ago.

James Wallace originally pleaded guilty and was sentenced to die for the February 1984 deaths of 36-year-old Susan Insalaco and her children, 16-year-old Anna Monzon and 12-year-old Gabriel Monzon.

The case has been appealed several times.

Last year, the Arizona Supreme Court overturned Wallace's death sentences in the children's slayings and sentenced him to life in prison for killing Insalaco.

Jurors deliberated for about eight hours over two days before deciding Friday that Wallace's childhood and substance abuse didn't mitigate the "heinous and depraved" way in which he killed the children.

The death sentence for the 59-year-old man will be automatically appealed.
 
I'm fairly neutral on this subject, but one reason that I think we should not have it, is that I flat don't trust the government. I don't trust that they should be the only entity that should have a legal ability to kill someone who is otherwise incapacitated.

But it doesn't surprise me that a big government conservative wants the government to retain that power. Just like it doesn't surprise me that the big government left will cry about the wars that we start and manage, and then want the same government to manage our healthcare, retirement, education......

Government fucks up. But you big government types are selective about what you care about, thus bigger, more invasive government.

So don't be surprised when your beloved government, which reserves the "right" to kill people, ends up fucking you over in every other aspect.

I oppose the death penalty because I simply don't believe human beings are infallible. Human institutions are, thus, capable of making mistakes and deliberate injustices. The state, which has a monopoly on force, is most certainly not exempt from human errors, nor of deliberate injustice.

When it comes to horrible, heinous crimes - these are times when people want to have the death penalty. However, this is typically about emotional reactions to egregious crimes. I also have these emotional reactions and have thoughts that a child-rapist who murdered his mother and tortured animals should probably be rubbed out of existence. However, this is not justice. Justice is about protecting society from criminals - in these terrible instances, this means life in prison without parole; society is protected, justice is served.

I would rather have all the terrible murderers in the world spend their lives in prison and not receive the death penalty, than have one innocent person executed for a crime they did not commit. This is also justice. Sometimes, living in and preserving a free society means that we have to do difficult things, like separating emotion from justice.
