PA state CONSTITUTION bans no-excuse mail-in voting but 35% of 2020 vote was mail-in

What is so hard to understand?

Republicans shopped for a court that would give them a result that they were looking for. It was their biased interpretation of the state constitution.

So their ruling was overturned by a higher court that interpreted the state constitution properly. Why can't you grasp that?

and i got them to admit they are wrong in saying Constitutions do not get interpreted

Of course they get interpreted by courts all the time. The far left and far right can read very different things into the Constitution and that has to be litigated and decided by judges.

Text Drivers enter point has been debunked as garbage.

You're not asking state judges to interpret the state constitution. You're telling the judges to put themselves above the constitution and rewrite it. Well - they can't do that. You want to change the constitution you have to go thru the amending process. THINK

No. I need you to be less stupid.

Judges ONLY get involved when there is a dispute between two parties. We do not just go to judges and ask them opinions.

What they do is settle disputes by listening to both sides and then interpretating and apply the law or the Constitution.

That is EXACTLY what they do, each and every time and why INTERPRETATIONS flux when the court swings between liberal and conservative.

You really need to stop talking as you are embarrassing yourself with your stupidity.

THIS IS NOT AN INTERPRETATION BY THE JUDGES. THEY SIMPLY DECIDED TO VOID A CLAUSE IN THE STATE CONSTITUTION AND THEY CAN'T DO THAT.

BUT YOU NOW AGREE THAT WHEN YOU HAVE DISPUTES OVER WHAT THE CONSTITUTION SAYS (SUCH AS BETWEEN PROGRESSIVE AND CONSERVATIVE POSITIONS IN A LAWSUIT) THAT THE JUDGES DO INTREPRET.

So I will take you now reversing your position that Judges do not interpret the Constitution and that you are wrong as a first step.

You want proof Child Molester Biden stole the election here it is. The percentage of mail-in ballots should have been around 1% as it should be everywhere. TRUMP WAS ROBBED and the robber is pedo joe. Lock the pervert up forever.

Here's Article 7, Section 14. Point out where it says mail-in ballots are banned.

§ 14. Absentee voting.
(a) The Legislature shall, by general law, provide a manner
in which, and the time and place at which, qualified electors
who may, on the occurrence of any election, be absent from the
municipality of their residence, because their duties,
occupation or business require them to be elsewhere or who, on
the occurrence of any election, are unable to attend at their
proper polling places because of illness or physical disability
or who will not attend a polling place because of the observance
of a religious holiday or who cannot vote because of election
day duties, in the case of a county employee, may vote, and for
the return and canvass of their votes in the election district
in which they respectively reside.
(b) For purposes of this section, "municipality" means a
city, borough, incorporated town, township or any similar
general purpose unit of government which may be created by the
General Assembly.
(Nov. 5, 1957, P.L.1019, J.R.1; May 16, 1967, P.L.1048, J.R.5;
Nov. 5, 1985, P.L.555, J.R.1; Nov. 4, 1997, P.L.636, J.R.3)

1967 Amendment. Joint Resolution No.5 renumbered former
section 14 to present section 11 and amended and renumbered
former section 19 to present section 14.
1957 Amendment. Joint Resolution No.1 added present section
14 (formerly section 19).

Yes exactly. It lists the REASONS why a mail-in ballot can be issued. The applicant has to have a reason. No-excuse mail-in ballots are not allowed. PA just mailed out ballots to everyone!!!!

BUT YOU NOW AGREE THAT WHEN YOU HAVE DISPUTES OVER WHAT THE CONSTITUTION SAYS (SUCH AS BETWEEN PROGRESSIVE AND CONSERVATIVE POSITIONS IN A LAWSUIT) THAT THE JUDGES DO INTREPRET.

There is no interpretation, you moron. The state constitution bans no-excuse mail-in ballots and everyone agrees with that.

Hey nitwit.

I am talking about you conceding you were wrong when it comes to OTHER Constitutional interpretations.

You started out saying that Constitutions do not get interpreted. Full stop.

You now admit they do.

Where do you draw the line between interpreting a law and rewriting it.?

Where do you draw the line between interpreting a law and rewriting it.?

Your question is flawed as we would not agree on what 'rewriting it' means but that is not what i was addressing with you anyway.

I was addressing your point where you stated that Judges do interpret Constitutions as that was wrong. And you admitted it was wrong.

You are simply not recognizing that the Far left and Far right, might read the exact same Constitutional Clause and yet come up with very different interpretations of certain areas of the text. You get stuck thinking, as many people do 'that the version i agree with is has to be the right interpretation and the right interpretation'.

But it is Judges who decide that. And as the Judges change so to does that interpretation shift.

^ That's a blatant lie. I've voted by mail since the pandemic and had to request a ballot every year, and there was a deadline to requesting one. Nothing in the constitution expressly forbids mail-in ballots. Read this.

"The Pennsylvania Department of State's
website for election returns shows that about 2.6 million mail-in ballots had indeed been counted as of November 27,2020.

More than 3 million voters had requested mail-in ballots as of the October 27, 2020 deadline, according to
a news release the same day from Governor Tom Wolf's office... '

I gave you the constitutional quote, you idiot. You can't just ask for a mail-in ballot. You have to prove you are entitled to one. But the state just mailed them out by the millions.

If you're a registered voter, yes you can "just ask for a mail-in ballot." All you have to do is fill out the ballot request form and send it in. You don't have include a doctor's excuse or a copy of travel documents.

Stop believing RWNJ lies about voting in PA. At least ask someone who actually lives there to give you the facts, numbskull.

.

HAHAHA. You don't even understand what this thread is about. You have to prove you are in one of the categories that are eligible for an absentee ballot. That's what the state CONSTITUTION says. I realize the PA legislators violated that rule in 2020 and let everyone have an absentee ballot despite what their own state constitution says. That's the proof that the election results must be thrown out. THINK

Give an example of having to "prove" you're in one of the categories, hotshot.

  • Mail-in ballot – Any qualified voter may apply for a mail-in ballot. You may simply request this ballot without a reason.
  • Absentee ballot – If you plan to be out of the municipality on election day or if you have a disability or illness that prevents you from going to your polling place on election day, you can request this ballot type, which still requires you to list a reason for your ballot.

HARRISBURG — The state Supreme Court has upheld Pennsylvania’s mail ballot law, preserving for the time being a popular voting method that passed the legislature with bipartisan support but was later challenged by Republican elected officials.
In a 5-2 decision released Tuesday, the justices rejected the GOP argument that the legislature did not have the power under the state constitution to allow Pennsylvanians to vote by mail without an excuse.
The 2019 law, known as Act 77 and employed for the first time during the contentious 2020 presidential election, ushered in the most sweeping expansion of voting access in Pennsylvania in decades.
