Biden camp reportedly fears photos from special counsel classified docs probe could devastate re-election bid

President Biden's team reportedly is fearing photos included in Special Counsel Robert Hur's imminent report on the handling of classified documents could impact his 2024 re-election bid.

Axios reported that Biden's aides do not expect criminal charges as a result of the investigation, but they are concerned about potentially embarrassing photos included in Hur's expected report that could be released as soon as this week. The images could show how Biden stored classified materials, which were discovered in late 2022 in the garage of Biden's Delaware home, as well as in a private office he used. The classified documents were carried over from Biden's time as former President Obama's vice president.

Biden's aides told Axios that they are fearful former President Trump's campaign could use the photos against the Democrat incumbent ahead of their likely 2024 rematch.

Trump himself is facing more than 40 counts, including obstruction of justice and willful retention of national defense information, for improperly storing classified documents at his private residence at Mar-a-Lago in Florida after leaving the White House following a probe by Special Counsel Jack Smith. ...

Unequal justice. Biden took classified documents from a SCIF. It they prosecute Trump Biden needs to be prosecuted also.The 14th Amendment to the United States Constitution states that no state can deny any person within its jurisdiction equal protection of the laws.

Title 18 U.S.C. 1924 makes it a federal crime to knowingly remove classified documents or materials from their designated locations without authorization or retain them in an unauthorized area. Simply put, this federal statute deals with the unauthorized removal of classified documents.

Joe’s garage is not an authorized area, nor is his Corvette, or his library.

This is the law with the word you gloss over made big enough for you to see.
(a) Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both.

Having documents is not a crime in and of itself. It isn't a crime until you can prove someone KNEW they had the documents. When you tell someone they have documents, then it is pretty easy to prove they know they have them. (That is the case with Trump, he was told he needed to return them and refused.) In the case of Biden, he had his attorneys do a search and reported that he had them and then returned them when they were found. That makes the knowingly part of the law impossible to prove for Biden but easy to prove for Trump.

Executive Order 13,526 further mandates that “classified information may not be removed from official premises without proper authorization.”

If Biden was authorized to take the documents, they were stored in violation of the Storage of Classified Documents Law.

If Biden asked for authorization, he most certainly knew where he stored them.

The problem is you have to prove beyond a reasonable doubt that Biden knew he had the documents before you can convict him. That is an impossible task when the standard is assumed innocence and there is no one that can show Biden accessing those documents.

In the case of Trump, it is easy to prove knew he had the documents since he was told to return them and didn't.

Willfully retaining documents that you are asked to deliver to an officer or employee of the US is a felony even if you received them lawfully.


The other crimes Trump is charged with are also felonies.
18 USC 1512 (20 year max sentence)
18 USC 1001 (8 Year max sentence)
18 USC 1519 (20 year max sentence)

It seems Trump isn't charged with a single misdemeanor for willfully retaining the documents and lying to the government about having them in his possession. All the crimes charged are felonies.

By the way, no one can be charged with a crime that occurred prior to the law making it a crime. It's right there in the US Constitution preventing that from ever happening.
