I can tell you, everyone has a an absolute right to have X if they want it, but by default, if you do not check this box and ask, we will be giving everyone 'Y'. But as long as you ask you will get 'X'.

But again, being a stupid person you will say, 'if you make me ask, and then i get it... you still denied it to me, as i should not have to ask'.

I went to the article you linked to and it says this:

Again i remind everyone the 7A guarantees you the right to a jury trial in any case over $20. No exceptions given, but NY says trump had no right to a jury trial.

Habba nor Trump requested a jury trial as the only requirement to do so, is to check the box, and they REFUSED to do so.

Call them stupid, just as you are, that they cannot follow a process.

Had they checked the box, then from there the request would have to be considered and adjudicated if the Judge refused.

Saying 'you are entitled to request a jury trial but our default is a bench trail in this area, so you need to check the box and ask' DOES NOT deny you your right to a jury trial.

Just as if i say everyone is entitled to and can have a chocolate chip cookie if they want it buy they must ask or the they will get peanut butter, does NOT deny the chocolate chip.

Judges are not allowed to rewrite the constitution. The 7A applies in all civil trials. You want to restrict it to federal courts, go thru the amending process.

The law in NYS says very specifically you check the box to request a jury trial.

You ignore that and say 'but... but... i asked' and that is on you.

Learn to follow and process and the rules if you want something.

That settles it.

It's funny how you completely ignore the US Constitution. The legislature in a state laid out the rules for state courts. The state court then followed those rules.
Where in the US Constitution does it say that the federal government writes the rules for state courts? Anything power not granted to the federal government is reserved for the states.

You didn't read the rest of the article did you?
The judge didn't accept her statement at that time. There is a time and place for all arguments. Making them at the wrong time doesn't mean you made the argument.
In order to have a jury trial in NY you have to submit the paperwork to the court. There is no verbal way to request a jury trial in civil court because there needs to be a court record.
