Trump wasn't charged because he stole government documents, including national security documents. The JD didn't even get involved until after the National Archives was compelled to report Trump had the documents and was refusing to return them. Even then, JD made efforts to recover the documents on a peaceable basis but Trump continued to diss them. THEN came the indictment.
