The Constitution requires it and it would be very difficult to sort that out in counting and drawing district lines. It does show up in the "foreign born" category.

No, it wouldn't, and the Constitution doesn't require it. Illegals aren't just "foreign born," they are foreign nationals and not US citizens. All it takes is a box on the form that asks, "Are you a US citizen?" Lying is a serious crime. On the other hand, illegals might not even bother to answer at all anything on the form fearing they might get arrested and deported.

What does the Constitution mean by "the whole number of persons in each state excluding Indians not taxed." That has long been interpreted as everybody. It says "persons" and not "citizens." This issue was probably discussed when Congress debated proposal of the 14th amendment and should be in congressional records.

I doubt seriously that many people have ever been prosecuted for lying on their census form. Nobody has been prosecuted for failing to answer the census since 1970. The Census Bureau estimates 18.8 million are not counted. After every census states and cities sue the Census Bureau for undercounting their population which affects both their representation and federal funding. It is $100 for failing to complete the form and up to $5,000 for giving false information.

The Census is a huge task. To check the accuracy of each answer becomes impossible. That is why everything Democrats or Republicans want to do results in higher spending and bigger government.

You would have to draw 435 congressional district lines of 750,000 people including only citizens.

"Indians not taxed" would infer that persons who are not taxpaying citizens are not to be included. That is, foreign nationals here as tourists or here illegally.

It meant tribal Indians. Indians who lived independently were taxed.

Everybody was included for representation purposes who lived here unless they were tribal Indians. Foreign tourists do not live here. I think at the time this was written there were not people here "illegally" because no immigration laws yet existed.

“But if you think about the motives for the crime that’s taking place at our southern border, that is it. That’s what the Democrats are trying to do,” he said. “And it’s a sheer power grab. It’s cynical as hell, and it’s actually the most straightforward explanation of why they would tolerate this carnage and mayhem. It’s in order to retain and gain power.”

As noted by Fox News, President Joe Biden’s 2021 executive order required the Census Bureau to count everyone, regardless of citizenship status.

“Illegal immigration has all kinds of effects and among them is that it distorts the mechanics of democratic government,” Mark Krikorian, the executive director of the Center for Immigration Studies, said.

“Illegal immigrants aren’t even supposed to be here, so their inclusion in the Census count for purposes of apportionment really is outrageous.

“There are a lot of close votes in Congress, more than there used to be. So, it can, in fact, make a difference,” Krikorian said.

Lora Ries, director of the Heritage Foundation’s Border Security and Immigration Center, said counting illegal immigrants for reapportionment purposes “doesn’t get enough attention, and with millions coming in right now, it deserves a bright, hot spotlight.”
