No, my argument is that an actual crime has to be committed. Actual harm has to have occurred. You can't charge someone for a "Thought crime." What the court did was extract a penalty for any future occasion where Trump might turn in iffy documents. That is, the court couldn't find him libel for the actual cases the state brought so they found him libel for any potential future cases that might be brought.

That is the very essence of a "Thought crime." The court became mind readers. The judge decided on the basis of his own opinion, and nothing more, that in the future Trump MIGHT, POSSIBLY, could repeat his behavior so on that basis he threw a half-a-billion dollar judgement against him. It wasn't on the basis of anything that has already occurred but rather on the basis of the judge using psychic powers, fortune telling, or some other equally stupid means of telling the future. That's the problem.

You are completely ignoring the judgement when you say the dollar amount was based on possible repeat behavior. The dollar amounts are based on actual gains realized by Trump that were the result of his filing of false documents. I posted the relevant parts of the court's judgement that show that is the case. The dollar amount is based on what Trump made in the getting reduced interest by lying about his financial situation and the profits Trump realized from selling assets he would not have been able to buy if not for lying on his financial statement.

There are plenty of cases tried under the law James used. In previous cases, a criminal case came first and after conviction, the defendant was then tried civilly to assess damages that resulted. For the first time in NY history, James went straight to trying Trump civilly--she had no criminal case and knows it--and shopped a judge that would gleefully hand down a sentence. They also had to make sure it was a bench trial, not a jury trial, because they knew that even if just one person on that jury objected--and there was a near certainty that would be the case--then their attempt to get Trump would fail.

YOU miss the point. Even the judge admitted that Trump caused no harm or loss. What he slapped that judgement on Trump for was the potential that in the future, at some unspecified point, maybe just maybe, Trump would fudge documents to get a loan and possibly, maybe, could happen, he'd default on that loan or otherwise cause a loss for the bank(s) involved.

That is the epitome of a "thought crime." In the US you cannot charge someone for simply thinking about doing a crime, nor can you charge someone for a crime they haven't committed but you believe will be committed at some point in the future. That is pure Stalin.

To call this judge shopping to get Engoran shows you know nothing about the process. Even if we eliminate the judges that are normally assigned certain issues, the odds of getting Engoran are about 5%.

Bullshit. There was never a criminal case against Trump for defrauding banks or other lenders over real estate deals. James applied the civil law to Trump that was, up to this point, used to go after assets of someone who was found guilty of criminal fraud. She bypassed that step.
