Where is it defined as an act of war?

Here's what I don't understand. Did you want the military to show up in Detroit, take custody of the guy and whisk him away somewhere? On what authority? And do what with him? Do you think it is a good idea for the military to do that sort of thing as a general matter?

Its an act of war during the WOT.

After local apprehension the suspected terrorist should be handed over to the military and dealt with accordingly.

Who decides what is and what is not an act of war during the WOT? Who decides which persons should be handed over to the military after being apprehended?
