Ohio's ban on most abortions is unconstitutional and cannot be enforced, a Hamilton County Common Pleas Court judge ruled Thursday after voters approved a reproductive rights amendment last November.

Judge Christian Jenkins granted a permanent injunction Thursday. He ruled that Ohio's abortion ban violated voter-approved language added to the state constitution to protect access to abortion, contraception and other reproductive decisions.

“Ohio voters have spoken. The Ohio Constitution now unequivocally protects the right to abortion,” Jenkins wrote.

The law that was struck down bans doctors from performing abortions after embryonic or fetal cardiac activity is detected, which can happen as soon as six weeks into pregnancy. GOP lawmakers passed the law in 2019, but it didn't take effect until the U.S. Supreme Court overturned Roe v. Wade in June 2022.

The law was in effect for 82 days before Jenkins, a Democrat, temporarily blocked it. Ohio abortion providers sued the state to halt the law, which led patients to seek abortions elsewhere and threatened the futures of several clinics. In one prominent case, a young girl who had been sexually assaulted in Columbus obtained an abortion in Indiana.

Outrage over Ohio's abortion restrictions fueled a ballot campaign to enshrine reproductive rights in the state constitution. Republican Gov. Mike DeWine admitted that the law he signed, which supporters called the "heartbeat bill," was out of step with what Ohioans wanted. The ballot initiative passed in November with 57% of the vote.
