Parliamentary Challenge from Senate on Reconciliation

According to what John Kyl said today, House democrats need to be leery of promises made by Nancy Pelosi, in securing votes for Obamacare. He said the House can not depend on ANY of the reconciliation "fix" bill to even be considered, because it will be challenged by the Parliamentarian, who will find it violates the rules of the Reconciliation Act. This challenge will not be overruled by the Majority Leader, or it hasn't been except for maybe once in history... his colleagues will then appeal for opportunity to debate, and the issue of whether any, if not all, of the reconciliation bill can be considered, will take place. Kyl says it is not likely the Democrats will get everything in the bill... all the sweetheart deals... all the bribes... all the revised language... it's entirely up to the Senate, and they will have to formulate a bill to be sent back to the House, to be voted on again, before signing into law.

In short... Nancy has made a lot of deals here, and she has sold democrats up the river, in order to get their votes. When the vote does move to the floor, it will be interesting to see who trusts Nancy to deliver on what Senator Kyl says she can't.

Senate Won’t Release Letter to Calm Nervous House Members on Reconciliation

Senate Democratic leaders have decided they will not publicly release a health care reform letter signed by their rank and file intended to calm nervous House Democrats before their historic vote this weekend on the comprehensive Senate-passed measure and a budget reconciliation bill of fixes.

Sources said a handful of Democratic Senators asked Senate Majority Leader Harry Reid (D-Nev.) to keep the letter private. The missive laid out a set of principles that Senatorial signatories would pledge to support in the health care reconciliation bill, which will need to be passed by the Senate after House action.

“The purpose is to give assurances to the House, and that can be done privately,” said one senior Senate Democratic aide.

Reid spokesman Jim Manley declined to comment except to say that Democratic leaders are “confident that the House understands the Senate is prepared to deliver.”

One senior House Democratic source said the letter had not yet been delivered to the chamber.

And one Senate Democratic source indicated that Reid had not yet been able to round up the 51 signatures he needed to provide the assurance that the Senate would be able to pass the reconciliation measure. However, the source cautioned that the inability to get 51 votes was not because Reid didn’t have personal commitments from 51 or more Senators, but because many Democratic Senators are squeamish about sticking their necks out before the House has passed the bill.

If the House passes both measures this weekend, the Senate will take up the reconciliation bill next week.

Apparently, it doesn't matter... if they are in this reconciled bill, they will likely be stripped by the Senate, IF the Senate even decides to look at the bill. Like Kyl said, it will be met immediately with a parliamentary challenge, and there is a good chance NONE of the bill will be considered by the Senate.

Nancy is telling House members not to worry about their issues, they will cover them with this reconciliation bill, they just have to agree to "deem and pass" the Senate bill first. Now these are grown people, they are supposed to have enough sense to understand how things work in Congress... I hope they aren't thinking this will wash when they claim they got tricked into voting for the Senate bill.
 
Deem & pass is out. Going with the 216 number, they have more than that. So, guess it will be interesting to watch the state challenges on forcing people to buy.

Where is the transparency of our governing body? Why should decisions about our lives be kept private until they are official?
 
Deem & pass is out. Going with the 216 number, they have more than that. So, guess it will be interesting to watch the state challenges on forcing people to buy.

I don't think so, my understanding is, they already voted on the "deem and pass" and the vote which is scheduled for Sunday is on the reconciliation bill, which the Senate will have to approve. The reports are, they have the 216 to pass the reconciled bill, but that remains to be seen. If the reconciled bill happens to fail, they will no longer be able to "deem" the senate bill passed, the purpose of that is to pass the reconciliation bill, so they would have to have an up or down vote on an unamended Senate bill, which will not pass. If they do get the 216 to pass the reconciliation bill, it will go to the Senate for approval, which they've already said they will not give. Meanwhile, the Senate version of health care reform is signed into law by the President, to the chagrin of idiot House members who got snookered, or so they will have you believe.
 
The Vice President decides what is good enough for reconciliation. If Joe Biden didn't believe it was good enough, they wouldn't be pushing this anymore.

They aren't using the deem and pass procedure in the house, it was announced today. There will be two roll call votes.
