It actually is not. Holding people in jail(or prison) without a court order is kidnapping. Guards do not have to evaluate whether a prisoner is innocent.Holding innocent people in jail is kidnapping.

If someone gets a Presidential pardon, they are released from prison or jail immediately. There is no court decision involved. The courts get ZERO say in that. The person is released.
