Another day and another dreck judge poised to get a smackdown.

T. A. Gardner

Thread Killer
This time it's U.S. District Judge William Alsup of the 9th Circuit out of San Fran that's getting stomped on. You'd think he'd have learned from the last half-dozen stompings he's received from his anal ruling from the bench without merit.

He lost to higher courts on student loans. He lost four cases brought before him on DACA to higher courts. Basically, this Clinton appointee has been wrong every time he's ruled against Trump, yet here he is doing that again.

This time he's saying OPM and Trump cannot fire federal employees because it could harm national parks and monuments at some point in the future. He further claims that firing probationary employees is "illegal" (without citation).

Another smackdown is coming Alsup's way...

You do have rights in employment. They cannot fire you without cause. Lies do not equal cause. Well, they do for you.

Probationary workers can be fired without cause. The argument before the judge is that OPM fired them, not their agency. What the plaintiffs left out is that OPM was acting on Presidential authority and an order from Trump to do so.
