According to JPP marxists the 14th Amendment was written with the express intent on applying to any and all immigrants at the time of its passage. That is what they claim.

They believe that should Chiquita Gonzalez step across the boarder and squirt out a fetus, said fetus is automatically and without equivocation considered a US Citizen with all rights conferred immediately.

For the same of argument, let's presume that is indeed a fact (I do not agree) but let's presume it is.

What then happens to Chiquita? She surely isn't an automatic citizen by virtue of squirting out a fetus is she? Does that mean Chiquita gets deported back to where she came from and the fetus stays here? Who takes care of the fetus? What happens to the fetus?

The fetus is a person at that point, but her parents take her with them if they are deported. She remains a citizen.

Since then the Court has numerous times confirmed birthright citizenship beginning in 1898 establishing it as existing precedent law

As for the mother, I’d say yes she can be deported, and the kid would still have citizenship if it left with her

Why was Elk of Elk v Wilkins not an American citizen? Why weren't Native Americans American citizens prior to the Snyder Act. Why was the Snyder Act even needed. I will await your answers.

Technically because he was born on a sovereign reservation considered outside of the U.S. jurisdiction, the kid born today claiming birthright citizenship would have to be born in the US, why is that difficult?

Nope, Indians born on or off the reservation prior to 1923 were not considered to be American citizens. And why was the Snyder Act even needed?
