Obama asks SCOTUS to toss out Az employer sanctions law

The Obama administration has asked the U.S. Supreme Court to toss out Arizona's law that punishes businesses that employ illegal immigrants.

The Justice Department says the employer sanctions law is preempted by federal laws, and that lower court rulings in favor of the Arizona statute should be reversed.

The Legal Arizona Workers Act requires employers to verify the employment eligibility of workers via the federal E-Verify database.

Arizona's law's effect is to "disrupt a careful balance that Congress struck nearly 25 years ago between two interests of the highest importance: ensuring that employers do not undermine enforcement of immigration laws by hiring unauthorized workers, while also ensuring that employers not discriminate against racial and ethnic minorities legally in the country," according to a brief filed by the administration.

The Immigration Reform and Control Act of 1986 precludes states from penalizing companies for hiring illegal immigrants. But the law allows states to have "licensing or similar laws."

"The Arizona statute is not at bottom a 'licensing or similar law,' " Acting Solicitor General Neal Katyal wrote in the brief. "It is instead a statute that prohibits the hiring of unauthorized aliens and uses suspension and revocation of all state-issued licenses as its ultimate sanction."

i can see obama's position if this is in fact preempted, however, without more information of the laws in question, i can't say for sure it is. in the spirit, on its face, it does not look like it should be preempted. IMO, this shows we need a major overhaul of federal immigration law, it needs to be clear what states can do to enforce federal immigration law becuase it is clear as day the federal governmetn has failed for decades....

When Bush had ICE go to all the various businesses and round up the illegals, the turds whined that he should be going after the businesses that employ them. Now that Arizona is cracking down on the employers, Obama wants to give them a pass.

that is absolutely... unequivocally... without a doubt... untrue....states can enforce federal laws, scotus has ruled such (specifically in immigration) and the feds can fail and to any rational objective non partisan mind it is clear they have failed

In any federal system of law, preemption refers generally to the displacement of a lower jurisdiction's laws when they conflict with those of a higher jurisdiction.

As long a Az. law DOES NOT conflict with the federal law, Obama the Asshole can go pound sand....and according to Az., they say their state law only mirrors or says exactly the same thing as federal law....

The military does not allow illegal immigrants to enlist, and that policy would not change, officers said. Recruiting officials pointed out that volunteers with temporary visas would have already passed a security screening and would have shown that they had no criminal record.

Immigrants who are permanent residents, with documents commonly known as green cards, have long been eligible to enlist.

Thats not to say that illegals, using fraudulent documents, don't get through the screening an enlist...

i can see obama's position if this is in fact preempted, however, without more information of the laws in question, i can't say for sure it is. in the spirit, on its face, it does not look like it should be preempted. IMO, this shows we need a major overhaul of federal immigration law, it needs to be clear what states can do to enforce federal immigration law becuase it is clear as day the federal governmetn has failed for decades....

Uh, that's the point. If it's illegal why was Sgt. Denogean allowed to have a military career for 25 years before becoming a citizen? Why don't illegal aliens have to become citizens before enlisting?

You understand that many Mexicans think their countrymen are being recruited as cannon fodder. Some recruiters may be overzealous but they give the rest a bad name because of their actions.

Actually, there's a long world tradition of military service leading to citizenship for people. That was one of the incentives in forming foreign legions. While we have never had a foreign legion in the US, I don't think it would be a bad idea, either...

Aw, blow it out your barracks bag. The fact is that Sgt. Denogean spent 25 years in the military but suddenly got fast-tracked to citizenship right after meeting bush. Granted the government can be incompetent, but it would take a special kind of bungling to let any illegal through the system, with all the resources govt. has to check up on people. They can't thoroughly examine documents to uncover fraud? An internet user could do it, just by taking on the tedious job of poring through public records.

About 70,000 foreign-born men and women serve in the U.S. armed forces, or about 5 percent of the total active-duty force, according to the Pentagon. Of those, nearly 30,000 -- or about 43 percent -- are not U.S. citizens.

You seem to be saying that the armed forces can be a little loosey-goosey on the illegal business but the private sector can't.
