If your argument is correct then the higher appeals court will reinstate the financial penalty since there was fraud. But your argument flies in the face of reality.

The relevant statute does not require that there be a monetary fine, but says supreme court (the lower court in NY) may enjoin any illegal activity, order restitution and damages and, in some cases, cancel business certificates. It does not state that without financial restitution the case should be tossed.
