this ignores Article 1 section 4 which gives both the US Congress and the State Legislatures this authority. While Congress never used the authority until 1842 when setting requirements for Congressional Districts it does not change that they have Congressional authority to regulate elections at that level.
Article 1 Section 4 reads thusly (pay particular attention to the bolded portion): The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.
