A hate crime is doing violence to a minority because they are a minority. It is not simply doing violence to a minority. That is ignorance. There has to be intent, because intent and state of mind are the most important parts of criminal law.
No disrespect Alias but when you are calling someone a bigot in another thread for religious bigotry and then in this thread you use the term queer in a deragatory manner it comes across as pretty hypocritical. You may not care, and that is your right, but I'm just stating what's pretty obvious.
And to answer the question I'm guessing you would ask gay people don't call themselves queer. Yes I am aware of the TV show but that is an exception. It's sort of like liberals who call Tea Party people Teabaggers and claim they do so because that's what Tea Party people call themselves. We all know what the intent behind using the word is.

I would guess it's not a hate crime because the guy beating up the homosexual, was also homosexual, you might as well call a black man attacking a black man a hate crim. As for the second article you posted that one's even more laughable, some college student graffitied a dorm and used the N-word and the college president called in the FBI because he considered it a hate crime. Are you guys serious? Find some real hate crimes, you know, like five Texas christans beating the shit outta a vocally gay man, thats a hate crime, some guys attacking a muslim woman wearing a burqua, that's a hate crime.
