Should the shooting spree soldier be tried in Afghanistan?

The Afghan president wants NATO troops out of rural areas.
 
and i want a million dollars, neither of us is likely to get what we want

besides, who is to say that a court martial will not provide justice or do the afghans want revenge...

Well, if it's true that 9 kids were murdered here, the parents likely want revenge. They are probably a lot like Americans that way. Someone kills your kid = you kill them. I mean, it's pretty basic I think.
 
Do they ever actually hand down a death sentence to any of these guys though? I can't remember.

Yeah, the military often will sentence people to death. He will get a lawyer though and may get only life in prison because of mental health issues.

I hope so. I don't like being forced to pay for the government sanctioned death of another.

For killing foreigners? This was without a doubt one of the worst cases I have ever heard of. You may remember it? They stalked a 15 yo, murdered her entire family including her six year old baby sister, gang raped her, and then set her on fire. He didn't get the death penalty.

So I am curious as to when they do give it?

Just my opinion, but nah, he didn't do that. We did that a long time ago. This is what perpetual war brings btw. Not a surprise. I wonder how long he was over there for? I wonder how many of his commanding officers knew he had problems? I wonder how many people could have stepped in and stopped this before it happened. When Steven Greene decided to stalk, gang rape, murder, set on fire, and slaughter an entire family in Iraq, it ended up that the answers to those questions were really very disturbing.

WASHINGTON, (SANA): The US soldier suspected of killing 16 Afghan civilians in a shooting rampage could face the death penalty if convicted, US Defense Secretary Leon Panetta said on Tuesday.

The Pentagon chief told reporters aboard his plane en route to Kyrgyzstan that the suspect in the Afghan shooting spree would be brought to justice under the US military legal code, which allows for the death penalty in some cases.

Asked if the suspect could be sentenced to death, Panetta said: “My understanding is in these instances that could be a consideration.”

Panetta condemned the incident as a “terrible loss of life” and said it remained unclear what may have led the gunman to murder civilians.

And UCMJ will likely try him under capital murder laws. He may be executed.

unless the court finds diminished capacity or outright mental illness

there is the part about his brain damage and the military's negligence in treating it properly

Okay, but I betcha he won't be. I would bet you anything, you name the terms, and you'd have yourself a bet. Not that I am for the death penalty.
