What happened
A Tennessee sheriff's deputy, McAbee traveled to Washington D.C. for Trump's rally while he was on temporary disability leave from work after rolling his car. He wore a tactical vest at the Capitol riot with the Three Percenter logo and the word sheriff. Federal officials say after assaulting officers on the scene, he pointed at the word "sheriff" to try to get access to the Capitol after he was injured in the battle.
He is one of seven men charged by a superceding indictment in the brutal assault on officers during the melee on the Capitol's lower west terrace. Documents state McAbee is shown on police body-camera footage carrying a baton and swinging at officers while wearing gloves with reinforced metal knuckles. He's shown grabbing the torso of an officer already on the ground while Clayton Ray Mullins, also of Kentucky, grabbed the officer's legs in what became a tug-o-war between the two men and other officers trying to prevent further assault. Soon after, McAbee grabbed the same officer and dragged him down the stairs into the crowd as others kicked, stomped and struck him with poles. The footage shows McAbee pinning the officer down for about 25 seconds. Afterward, the officer needed medical attention for a head laceration.
A tipster turned McAbee in on May. 26, reporting he previously was a deputy in Georgia who had relocated to Tennessee. He was a deputy with the Williamson County Sheriff's office. After Jan. 6, he deleted his Facebook account. In court documents, the U.S. Attorney's office stated: "The fact that McAbee engaged in violent assaults of fellow law enforcement officers while he himself was a sheriff’s deputy and then attempted to use that status to obtain special treatment is powerful evidence of his lack of regard for legal authority." The motion arguing for him to be detained also stated: "The defendant was a spoke in the wheel that caused the historic events of January 6, 2021, and he is thus a danger to our society and a threat to the peaceful functioning of our community."

The emblem is associated with the three percenters, an anti-government militia movement. The man was also wearing black gloves with hard metal-colored knuckles.
The video shows on Jan. 6 the man tried to drag an MPD officer into the crowd as other officers tried to bring their colleague back to the line. When an officer attempted to help the fallen colleague, the man appeared to jump up and swing at the officer.
Later, the man appeared bent over apparently in pain in the archway of the Capitol, court documents stated.
As the crowd surged at the police line in front of the Capitol, the man appeared to hurt his shoulder and said it was broken. He then pointed to the sheriff patch and told MPD officers he couldn't go back the way he came.
In the pre-trial motion, prosecutors said this action is "powerful evidence of his lack of regard for legal authority" because McAbee tried to use his status as a law enforcement officer to gain access, despite having just assaulted several MPD officers. "
