Adultry should be illegal. And I think might still be in some states...
It is a violation of a marriage contract. Which is a legal government document.

Thats an interesting point USC it usually is although the marriage contract is codified and is verbal which is mainly seen as ceremonial. Can we make not loving and honoring your spouse illegal as well? I think not.

However if two parties actually sign a legal contract saying one or both partners may not engage in adultery I can definitely agree with it being breach of contract.

And if it is not a government "document" / contract, why would the government need to approve or disapprove of gay marriage ?
