“HELENA, Mont. (AP) — A Montana judge on Monday sided with young environmental activists who said state agencies were violating their constitutional right t o a clean and healthful environment by permitting fossil fuel development without considering its effect on the climate.”

“The ruling following a first-of-its- kind trial in the U.S. adds to a small number of legal decisions around the world that have established a government duty to protect citizens from climate change.”

The actual importance here isn’t the decision, energy interests will surely appeal it to death, but the fact it was bought by young citizens, those that will inherit the mess we leave them. They will be the answer to climate change, not be Boomers, the bought off politicians, nor selfish people who don’t want to give up their F250 Duallies. Hopefully, it is not too late

Regardless, this judge said it was unconstitutional to do this but there is nothing in the constitution that says this, it will be overturned on appeal.

Nothing in the Constitution on a lot of things, nothing in the Constitution specifies anything about campaign spending, called interpretive law, and you missed the point, it is not the case, but the fact that it was started and backed by youth interest, those left with the world they inherited from the selfish
 
Judges now often make it up as they go....the Constitution is over but until it is recognized to be over Judges are forced to claim that their dictates are based upon the Constitution....it does not mean anything.

The crux of their legal argument is Montana’s continued development of its coal reserves and other fossil fuels break the state’s constitution, which since 1972 has guaranteed the right to “a clean and healthful environment.”


This is the part of the state constitution her ruling was based upon.

Protection And Improvement
Section 1. Protection and improvement. (1) The state and each person shall maintain and improve a clean and healthful environment in Montana for present and future generations.

(2) The legislature shall provide for the administration and enforcement of this duty.

(3) The legislature shall provide adequate remedies for the protection of the environmental life support system from degradation and provide adequate remedies to prevent unreasonable depletion and degradation of natural resources.

The problem here is that this provision in the state constitution isn't lawful because the plaintiffs can prove any actual harm.

For this part to be applicable there must have been damage or harm committed.

Her ruling is implying that there may be harm in the future but there is nothing to back that up.

This is why it will be overturned.

The judge has no such authority.
