Don't have any solid opinions about her quilt but it's obvious that Italy doesn't have the same standards of jurisprudence as the US does as some of the legal prosecutions would violate US Constitutional law.
What I'm interested in is will the US permit her being extradited to Italy to serve her sentence?
Exactly and what are the reprocustions if we don't?
how does that work if it's the same criminal act?
I think that if these things are not decided within six months, the accused should go free.
The crime is defined by the law, not the act. So one act might break several laws, they can be tried at separate times or in separate courts.
that is double jeopardy. your lawyerly speakese crap doesn't change that.
If I go into a bank and brandish a gun, demand money, and shoot the guard dead... the same acts would violate a variety of crimes. Some of those crimes federal and some state. The Fed's can prosecute what they want, and what they don't prosecute the State can prosecute. So, for example, the feds could be prosecute me for bank robbery and chose not to prosecute me for Murder. (Lets just say the State punishment for murder is more severe...) The State can still prosecute me for murder, even if a jury finds me not guilty of bank robbery.
