HREE JUVENILES accused of assaulting a cabdriver and his passenger in Center City Saturday night while shouting racial slurs will not be charged with a hate crime, the District Attorney's Office said yesterday.

The teens, who are black, were not charged with hate crimes because there was no evidence that the assault had been motivated by the race of the victims, who are white, said Tasha Jamerson, D.A. spokeswoman. Just shouting racial epithets during the commission of a crime doesn't rise to the level of ethnic intimidation, she said.

"They just didn't have that in this case," she said. "If they had somebody who, two blocks before, heard them say, 'We're going to beat somebody up because they're white, brown or purple,' it might be different."

so good news folks. as long as we only shout racial epithets DURING the assault and don't make any conspiratorial statements or premeditation, we won't be charged with a hate crime.

I can actually see where this is coming from, let's say you get into a barfight with an irishman and you're both yelling and swinging and totally hammered. Let's say for instance that one of the insults that comes out of your mouth is "fuckin mic potato peeling whore!" this is to avoid turning an assault charge(assuming the police show) into a hate crime charge. I agree it shouldn't be nessecary DA's should have more sense than that but really if you gget into it with a latino guy just by chance and are cursing him out as hard as you can, that's not really the same as getting two buddies together and saying, "we're gonna go out and beat the hell out of a fag" and then doing it.

2) 3 white kids beat a black guy yelling nigger and kunta kinte

who do you think is getting charged with a hate crime?

both? If there were three guys beating on somebody there was obviously premeditation they don't just all happen to show up somewhere and beat the hell out of the same guy of a different race.

One of the most common criticisms I've ever heard from conservatives about hate crime laws is an imagined scenario where a noble non-racist white male punches a hideous degenerate black piece of scum, and, in his totally justifiable passion, mutters some racial epithet which, under normal circumstances, he would never dream of uttering (he has a black friend, after all!), and is thus charged with a hate crime and sentenced to a million years in prison. Aren't you glad that this case proves this isn't so? If anything, if it had been white kids we would've never heard about this.

an easy example is "nigger" or "nigga". the word(s) is so overused and is now pretty much a common insult (thanks to rap) that i wonder what the actual racial slur was. did they call him a nigga? what?

it does make a difference.

Because 1 example is racist and the other is justified retribution, according to Poet; because Blacks can not be racist.

That's not what is going on here. Hate crimes come from attacking a race. These thugs were out just harassing whomever they could. Specifically stating that was the reason is what constitutes a hate crime. Are you not clear on that?
