PROSECUTOR: Kilpatrick Violates Probation

(WXYZ) - Former Detroit Mayor Kwame Kilpatrick could be facing more trouble with the court after coming up short on his restitution payment and paying late on top of that.

The Wayne County Prosecutor's Office issued a statement Wednesday saying Kilpatrick is violating his probation:

"It is our position that he has violated his probation. We have seen no proof that his salary has diminished and we have been asking Judge Groner for a restitution hearing for months."

Ex-Mayor Lives Lavishly, Restitution Payment Short $3,000

DETROIT -- Former Detroit mayor Kwame Kilpatrick is widely known to have an appreciation of the finer things.

In fact, questionable spending habits, like pricey city-leased SUVs, garnered unwelcome attention during his time in office.

And even now, it appears Kilpatrick hasn’t lost his lust for luxury though he still owes the city nearly $1 million, a court enforced payment for admitted wrongdoing.

Kilpatrick is required to pay $6,000 by the 15th of every month, until he pays back the restitution agreed upon in his plea agreement.

Yet this month, his payment was a day late and $3,000 short according to sources at the state Department of Corrections.

Kilpatrick’s attorney maintains that his client is not doing anything wrong. “Mr. Kilpatrick is compliant with his order, he’s doing what he’s supposed to to do, he is not violating the law and he is trying to turn a new page on his life. He's trying to do, what should be done to live a good wholesome and proper life,” said lawyer Michael Schwartz.

Kilpatrick pleaded guilty to two felony counts of obstruction last year and in addition to restitution, he was forced to resign his office, forfeit his law license and ultimately spent 99 days in jail.

However, repayment to the city has been inconsistent.

Earlier this year, Kilpatrick said he could only afford to pay $6 a month after expenses, those expenses included renting a million dollar mansion.

Kilpatrick’s request to change the payment amount was denied; however, he continues to fight to appeal that decision.

Since the request, Kilpatrick moved into an even larger home that sits inside an exclusive, gated community. The mansion is considerably larger than the 4,000 square-foot Manoogian Mansion, the official residence of the Detroit mayor.

Kilpatrick grosses approximately $10,000 a month at his job at Covisint, a subsidiary of Compuware Corp. owned by Peter Karmanos.

His new home is in one of the ritziest suburbs of Dallas. Southlake, Texas, is high priced real estate offering luxury shopping and fine restaurants.
