After hearing testimony Tuesday in a child sex case, a District Court judge took several minutes before sentencing a Post Falls man to 45 years in prison for molesting a 9-year-old boy.

Judge John Mitchell shuffled papers, used a yellow highlighter on the page of a court document and lamented quietly at the bench in the First District courtroom before sentencing Zachary J. Hubbard to a lengthy prison term.

Hubbard, 29, of Post Falls, was convicted of two counts of lewd and lascivious conduct in a case stemming from April when a child told a school teacher his anus was bleeding and that Hubbard had “sucked on his weiner.”

Calling the case “despicable and disturbing,” Mitchell sentenced Hubbard to a fixed prison term of 15 years with an additional 25 years indeterminate to be used at the discretion of prison officials. Mitchell however retained jurisdiction, allowing Hubbard to attend a one-year prison rehabilitation program before being considered for probation.

“I can’t, in good conduct, begin to fathom probation for you, right now,” Mitchell said.

A 21-year-old San Mateo man charged with 98 felony counts of child molestation and forcible sex acts on a child, among others, after he was caught allegedly molesting his 10-year-old relative earlier this month pleaded not guilty to all of his charges Tuesday, according to the San Mateo County District Attorney’s Office.

On Sept. 8, Christopher Greenbach was allegedly caught by the boy’s 13-year-old sister at their San Mateo home. She grabbed her brother and ran out of the apartment screaming. Though Greenbach ran after them asking them to stay quiet, a neighbor heard the noise and police were called to the scene, according to prosecutors.

Greenbach had allegedly been molesting the boy since early 2016 and threatened to hurt him if he told anyone about it, according to prosecutors.

A Canton man was indicted on charges of child molestation and rape charges after a Cherokee County sheriff’s deputy found him allegedly having sex with his 15-year-old girlfriend in his car.

Hilario Matias-Perez, 21, was indicted by a grand jury for one count each of child molestation and statutory rape, according to court documents.

Perez was arrested after a Cherokee deputy responded to a call of a suspicious gold Ford Mustang. Upon arrival, the deputy reported he found the driver side door wide open and saw Perez, 21, standing over a woman at which point “it was obvious the pair had been in the process of having intercourse,” the report stated.

Perez initially told law enforcement he was 18 years old and admitted his girlfriend was only 15 years old. He said they know each other and he had picked her up from her home.

The report states Perez “became extremely emotional, stating he had made a mistake, going so far as to throw himself at (the deputy’s) feet and begin praying and begging for mercy while grabbing (the officer’s) boot.”

The victim told law enforcement her parents did not know where she was, but that they did know she was with Perez. She told the deputy she had consented to intercourse, at which point the officer explained she did not have the ability to consent.

“I would call him a predator,” Assistant District Attorney Emily Johnson told jurors in Floyd County Superior Court, referring to a Rome man who was found guilty of aggravated child molestation on Tuesday.

After over two hours of deliberating, the jury returned to Judge Jack Niedrach’s courtroom to announce the guilty verdict for 28-year-old Dean Arce. He is also guilty of felony enticing a child for indecent purposes and a violation of the Georgia Controlled Substances Act.

Arce had also been indicted on two felony counts of child molestation but, before jurors left the courtroom to decide the verdict, Niedrach told them that these charges were no longer under consideration — the charges were dropped, he said. Sentencing for Arce will be scheduled at a later date.

There is a separate child molestation case against Arce, as well. No trial dates have been set.

In his closing argument, Arce’s attorney Noah Pines made the claim that lies had been told on the stand, and it was up to the jury to determine the credibility of those who testified, including victims.

The victim in this case was a 14-year-old when Arce began contacting her in summer 2014, when he was around a decade older than her.

Another victim, who was a friend of this girl, had introduced her to Arce and they began to talk.

“He liked the fact that she was young,” Johnson said.

New Orleans-based rapper Mystikal has just been indicted by a Caddo Parish grand jury for one count of first-degree rape and one count of second-degree kidnapping. According to KSLA News 12, Mystikal (real name Michael Lawrence Taylor) surrendered to authorities last month to try “to get this business reconciled, get this behind me, man.” He’s one of three people under indictment for an alleged assault on an individual at a Shreveport casino. One of the other people of interest has been charged with first-degree rape and second-degree kidnapping as well, while the third person has been indicted for obstruction of justice.

Mystikal was already a registered sex offender in the state of Louisiana before his indictment in Caddo Parish; in 2003, he was charged with sexual battery and extortion after he and two of his bodyguards forced the victim, the rapper’s hairstylist at the time, to perform oral sex and then accused her of stealing $80,000 in checks. The rapper pled guilty and served six years before being released in 2010.

Two South African men living in Murray, Utah, were arrested for allegedly raping an unconscious 14-year-old girl they had met over Snapchat, police say. Video evidence shows the girl was too drunk to resist the attack.

Richard Djassera, 21, and Leclair Dodjim, 24, were arrested by West Jordan police. They face a series of charges including aggravating kidnapping, rape, forcible sodomy, two counts of sexual exploitation of a minor, aggravated sexual assault and contributing to the delinquency of a minor.

The teenaged victim had been staying at a friend’s house when she somehow came across Snapchat messages from one of the men arrested.

They picked her up and took her to a list of places including a hookah bar, a house party, and a gas station to buy alcohol.

Later in the evening, two of the men began making sexual advances to the girl in the back seat of a car, but she was too drunk to stop them from doing what they wanted.

A third man began taking video of the assault because he “thought it was funny,” according to a police report.

Police say the video shows that the victim was mostly unconscious but did make attempts to push the men away.

According to a police report:

[Victim] appears to be unresponsive through most of the video, but does make attempts to push the person on top of her off,” the police report stated. “It appears [Victim] is passed out and/or unconscious throughout most of the video and clearly cannot give consent to anything that is happening to her.

Djassera and Dodjim were booked into the Salt Lake County Jail. Both were also charged with several previously existing charges that were not detailed in the reports.

Police did not announce any charges against the third man in the car who was reportedly named “Nash.”

In police documents, Nash said he was so drunk that he could not perform any sex acts and did not have sex with the girl despite attempting to do so.

Police became involved when the girl’s parents called them.
