Fox Guest's Voter ID Law Defense: "Voting Is A Privilege"

Fox News regular Jay Sekulow claimed that voting is a privilege as he went to bat in support of the Texas voter ID law today, and denied that such laws disenfranchise eligible voters. In fact, Americans are constitutionally protected from having their vote denied on the basis of race - which the Department of Justice has said would happen under Texas' law -- and voter ID laws have already disenfranchised hundreds of voters, and could prevent millions more from voting in this year's elections.

Sekulow was on Fox's America Live, debating the Texas voter ID law that was passed in May 2011, but was blocked by the Department of Justice because:

As a state with a history of voter discrimination, Texas must get preclearance from the Department of Justice for changes in election law. The DOJ blocked Texas' law under Section 5 of the 1965 Voting Rights Act, declaring that it would disproportionately affect Hispanic voters.

In his defense of Texas' voter ID law, Sekulow said: "Look, voting is a privilege. I mean, there are things you have to do to vote." He also suggested that he didn't find "asking for identification to make sure you're the person that's actually casting the vote" at all problematic.

After all this time...who knew?

Not you?

"In its 2000 ruling, Alexander v Mineta, the [U.S. Supreme] Court ... affirmed the district court's interpretation that our Constitution 'does not protect the right of all citizens to vote, but rather the right of all qualified citizens to vote.' And it's state legislatures that wield the power to decide who is 'qualified.'

As a result, voting is not a right, but a privilege granted or withheld at the discretion of local and state governments.... the U.S. is one of just 11 nations among 120 or so constitutional democracies that fail to guarantee a right to vote in their constitutions."

If it was a right, the states would not be able to take it away due to criminal conduct etc...

Not you?

It's not a right, but even if it was states could take it away due to criminal conduct, as with felons and guns. It should be made a right, though, through constitutional amendment so that these state laws are subject to more scrutiny than they are.

I stand corrected on that point. You are also correct that it should be made a constitutional right via an amendment.

your premise is flawed, one does imply the other
idiots all over this country have been DEMANDING things that have been rights to now be considered 'privileges' because people wanted to feel safe or that rights are not absolute. welcome to your unintended consequences of allowing that shit to happen.

We need less people voting, not more. Most people are dumb, the higher the vote turnout, the worse our country will be, as our candidates will have to increasingly cater to the lowest common denominator.

I suggest targeting propaganda at our youth first of all. We should emphasize the ineffectiveness of their sole voice. Now, the youth never vote anyway, so the point is to not only immobilize them for the time being, but also get various concepts to stick with them in the longterm.

One solution is to prey on our nations apathy and disinterest in our modern world and society. This may be useful with the "we are the 99%" drum circles. We could spin it to make not voting a sign of protest - That their lack of participation is an outright rejection of our institutions and cultural norms. Convince them that their vote, which they own, is a "gift" that they control, and they will refuse to give this "gift" or "consent" to a politician until our system improves.

We could also throw in a bunch of ineffective 3rd party candidates to give them an outlet for their frustrations, it will make them feel proactive and seem like they doing something positive, all the while we ensure their ineffectiveness.

Hopefully, potential voters become so alienated and disenfranchised that they just give up and focus on the minutia of their lives like their kids soccer games or what's on primetime the following night.

You're a sick bastard Grind! I bet you are usually too freaking lazy to even register to vote yourself though! Never mind actually getting down there on election day. Or mailing in a ballot.

according to our highest court in the land, they conclude that voting is a fundamental right. further, rights are not absolute. just because we have the second, does not mean a crazy person who wants to murder someone has a right to use a gun to do so.

or is this just your opinion?

so you do not believe in democracy?

funny, i am not to fond of it either, the trouble is that we have not found a better system

if you think that people are too dumb or not educated enough, work toward better education

perhaps the biggest problem is that people are too lazy to take the trouble to be good citizens

those two have no connection whatsoever.

how so? because one is an amendment and the other via scotus? do you believe the states and federal government are denying felons rights by now allowing them to own a gun?
can't believe I'm still having to explain this. the 2nd Amendment guarantees the right to keep and bear arms. It doesn't say a damned thing about any right to murder someone.
