Had Biden refused to cooperate with them and refused to immediately return the documents, the way trump refused to do, then the same actions would have resulted.
But Biden fully and immediately cooperated with them 100%.

Biden was President in January of 2023 when the documents were discovered by members of Biden's staff and legal team, who immediately reported their discovery.
The only way it got found out about with trump was because of a whistle blower.
His cooperation is not the issue.
He took classified material that he had no authorization while a senator and stored them illegally.
Of course he is "not competent to stand trial."
