Didn't =/= Can't. Mayorkas's crimes are he repeatedly lied to Congress, has failed to uphold the laws of the US--by his own admission--and shown massive incompetence in office. That's sufficient to warrant removal.

This was just the first minor skirmish in a battle that the Republicans will eventually win.
Lying to congress is a crime, I haven't seen that evidence, but if it exists Im okay with an impeachment. Incompetence and failing to uphold the laws are not impeachable.

United States Code, title 18, section 1001, a person who knowingly or willingly makes a material statement that is false, or fraudulent, to the feds, is guilty of a crime. What comes as a surprise to many is that unlike section 1621, section 1001 does not require that a person be under oath.

If as a federal official you fail to do your job with reasonable care or ignore legal statutes in the performance of your job, you can be held civilly and criminally libel for it. Mayorkas has done that.
