it is widely held that this Judge made a mistake in even having this as an open hearing that then descended into almost exclusively an exercise to dive into salacious details, intended to only embarrass Fani,in a very public way.

The judge instead, could have and should have, FIRST held a closed door hearing asking the accusers 'what is the thesis of this "actual conflict" you want me to consider', which if he examined BEFORE any of the personal details were discussed, he would have dismissed this.

The ONLY thesis offered to actual conflict was that 'Fani put Wade in place, so she could pay him with State dollars, so he could then pay for stuff for her and that is why Fani and Wade concocted this trial against Trump, that otherwise would not exist.'

That is easily provable false, in that Fani offered the case to other higher profile lawyers FIRST, chief amongst them the former governor, which would prove she was bringing the case regardless of whether Wade lead it or not.

At that point, if the accusers could not offer another thesis, the Judge should have disallowed it without the need to get in to all the HR matters.

BUt this judge is brand new to the bench and this was his first mistake, that we have seen.
 
He was never going to be the prosecutor in the courtroom. His role was administrative in nature. Assembling and managing the real prosecution team.

That doesn’t negate the fact that he never prosecuted a felony case. Suddenly he’s paid good money by his lover in his first felony case for assembling and managing the prosecution team!??!
It was a good ruling by the judge. Bad optics on Fani’s part.

No doubt bad optics. Really stupid decision making on her part.

However, it does not change the facts of the case one iota. He may or may not be replaced, but the case will move forward.
 
Optics weren’t good. Wade had never prosecuted a felony case yet was being paid a pretty penny by his lover who arguably could share that money with her.. Sure that’s a stretch but entirely possible.

It simply is not a good argument to say 'XYZ has never done ABC' as a way to suggest they should not be doing ABC.

If that was true, i would offer right now 'The Judge Scott McAfee, being the newest Judge in the circuit, has never heard any big cases, let alone arguably the biggest in State history and thus the optics are not good that he has this trail'.


Same goes for Aileen Cannon, on the Trump florida case.

But NO ONE is pushing the 'optics do not look good' as they have not got caught up in any other scandals tangential to the cases they are on.


No one has done a thing, until they are given a chance to do a thing, and if everyone was excluded for that reason, then no one would ever get there.

Wade as both a lawyer and judge, prior, has PROVEN himself across many areas in law, each of which he was new to, until he was not. He has received accolades in his roles, and been hired as Special Counsel by both GOP and Dem D.A.'s in other districts. He had never worked as a Special Counsel, until he did.

If any D.A wants to give him his first Special Counsel job (which someone did before Fani) and he proves not up to the task, that is on them, and the accused only BENEFITS. But simply because he 'has not done it yet' is NOT a reason to question optics and if it was then it applied to him getting his FIRST Special Counsel job. His first time as a Judge. And to Scott McAfee and Aileen Cannon handling their first big cases.

The ruling ensures this starts over. The conflict cannot exist, either he leaves or the office is removed... when he leaves a new prosecutor starts things over.
 
He’s hardly the lead prosecutor. His role was mainly administrative. Assembling and managing the prosecution team. He was never going to be the prosecutor in the courtroom. A pretty easy position to replace.

He was the work horse behind the scenes, and while i hate to say it, was more akin to the Associate Lawyer, who does all the legwork gathering all the evidence, searching all the precedents, and assembling the case to present to the senior lawyer (D.A in this case) who makes all the decisions.

That is in large part why the prior lawyers who Fani approached for this job all turned her down, apparently mocking it as Pro Bono work. As Fani was offering bottom of the payscale in Georgia, hourly pay, for what was going to be a ton of work.


So while you see Magats point at how much in TOTAL, Wade billed and was paid, that was for the immense hours needed to assemble what is playing out to be a massive RICO case, which are very complex cases to assemble.

What speaks to how good Wade's work was is that in such a short period of months, they already had a number of Guilty pleas and convictions, which means the opposing lawyers read the assembled evidence and felt the case was so strong, it was best for them to plead out.

The one thing you NEVER saw those accusing him of impropriety do in court, was trying to dive in to his docket. To audit it and question whether it was REASONABLE that the hours he worked matched the billings and seemed reasonable. Something that would be KEY to a claim of 'Actual Conflict', because if they could SHOW he was 'padding his hourly billings', and that 'Fani was signing off on them and paying them', then BOOM, that would be an actual conflict.

So why did those accusing Fani and him NOT even try to bring in the hours billed as 'unreasonable'? Do we assume they are stupid and forgot to look at that? Possible as they are Magat lawyers.

No it would be because they tore thru the hourly docket and found the actual work done and hours billed seemed reasonable, and they new the judge, having just left being a lawyer would easily be able to conclude that too, just as if he saw a padded docket, he would know, easily.

He must read all the discovery, etc. I don't think it resets the case but it delays it. I shouldn't write posts on the phone I truncate and idiots get the wrong idea of what I mean.
 
It was a ruling, and frankly a well thought out and legally sound ruling that will easily hold up under appeal. It isn't a 'trick'. The judge is doing his job. Not everything needs to be viewed through the lens of partisan politics.

I think Willis will see it as a vote of no confidence and resign. Either way it's a win for Trump. Everything will now go on hold until a new prosecutor is brought in and is ready to proceed.
