MONTGOMERY, Ala. (AP) -- The U.S. Supreme Court declined Monday to hear a challenge to Alabama's ban on the sale of sex toys, ending a nine-year legal battle and sending a warning to store owners to clean off their shelves.

An adult-store owner had asked the justices to throw out the law as an unconstitutional intrusion into the privacy of the bedroom. But the Supreme Court declined to hear the appeal, leaving intact a lower court ruling that upheld the law.

Sherri Williams, owner of Pleasures stores in Huntsville and Decatur, said she was disappointed, but plans to sue again on First Amendment free speech grounds.

"My motto has been they are going to have to pry this vibrator from my cold, dead hand. I refuse to give up," she said.

What's the ban enforced by, a fine?

Back whenever we had prohibition in Mississippi, we had a several dollar "fine" on alcohol providing establishments. The police went and took the fine one day, left, returned a year later, took the fine again... well, you can see the pattern.

Maybe the court has swung in the direction of state's rights

If so, now would be a good time to try and bring separate but equal and other segregation ploys to the fore

May be even medical marijuana and euthanasia

Umm in one of those states in that area, bestaillity is not illegal, at least it was not from an article I read a couple of years ago. I thought it was AL.

What about the European Union constitution?

I think they didn't mention that one.

Not really, you forget about Amendments 13 through 15 that took much of those things away from the States. If it is considered a Civil Right, Amendment 14 kicks in, here is where this particular law wouldn't be enforceable.

Now, the "Defense of Marriage" act made it so that only marriages between Men and Women would be considered binding on other states. It is my belief that the SCOTUS will deem that law unconstitutional some time in the future and states will be forced to recognize the marriages of homosexuals done in other states.

Anyway the bigger issue here. Think of all those unemployed dildo sales people in AL.....And will they get unemployment since they were doing an illegal job ?
