The number of Representatives is set by law. 435.

They are distributed by population. That population is determined by the census. The CONSTITUTION says EVERY person will be counted. That’s the “whole number of free persons” part. Not difficult to understand. Except for you constitutionally ignorant fucktards.

Okay, every person is counted but non-citizens aren't used as part of the count for distribution of congressional seats. That makes sense, since they don't have a vote, aren't citizens of this nation, and aren't represented by our government.

Poor comparison. The Constitution is clear about counting the "whole number." Free speech is more vague and its meaning is interpreted by the courts.

If you exempt a person who wants to perform human sacrifices from the law, it would create harm. However, the Supreme Court exempts several groups from obeying the law as part of its religious practices if no harm results from that exemption.
