Stop lying. He was shot one to two seconds after the gun was removed and he did not receive a beating during that time.

These are hardest cases to get convictions on as juries hate trying to get into law enforcements head and rule they did not have a legit fear, even when it seems they should not.

It is ALWAYS a bad idea to reach for something in your waistline while scuffling with police.

But in this instance the State must bring this to court and allow a jury to decide. It would be a travesty not to, for many reasons.

Void argument fallacy.

First, ICE must know this risk exists from State prosecutors, as they know Federal Prosecutors would allow them to murder with impunity. Even if found not guilty that will make some (most) ICE agents realize there is risk to their actions.

ALL federal officers know the risk they face doing their job.

Second, justice demands a jury decide this question.

If this case does not cross into irrational fear or negligent killing then i struggle to see any that would and the defense of 'I was scared' becomes almost absolute regardless of how things play out, and society should not want that.

I still don't know where the first shot came from... speculation about it being the weapon removed from Pretti notwithstanding, I wish I knew or could see that first shot.

You can clearly see the smoke from the accidental discharge of the confiscated weapon. That was the first shot. Watch the first segment closely, which shows the officer leaving the scrum with the weapon in his hand. You can see the discharge, and his arm swings up from the recoil. Maximize the video and go frame by frame to see it more clearly.

That isn't what caused officers to shoot him. He reached for his waistband while scuffling with officers. Always a bad idea.

You can hear a gun go off before Pretti was fired upon. That noise there is what makes me wonder if they will be able to call this justified.

Phone in one hand, glasses in another, what was he reaching for? Did his gun go off when the agent tried to clear it? Where was that first shot from? It wasn't from the agents that pulled their guns we can see them, they did not fire that shot.

This should definitely get into a review somewhere.

The agent was not trying to clear the weapon. It was facing downward as the officer created distance between that gun and the scrum.
