The older McMichael was not a police office. He had been forced to resign due to frequent violent attacks on blacks. His son never was able to get on the police force, because of frequent violent attacks on blacks.

The DA also tries to blame the victim for his murder, saying that Arbery "initiated" the fight yet he ignores the fact that the two men took the law into their own hands rather than call the cops and wait for them to take action.

The Georgia Bureau of Investigation is now investigating the Feb. 23 shooting death of Ahmaud Arbery, which followed a daytime confrontation with an armed father and son on a neighborhood street in southern Glynn County.

In a brief tweet released late Tuesday night, the GBI said it is investigating the fatal shooting at the request of Liberty County District Attorney Tom Durden.

Durden, who represents the Atlantic Judicial Circuit, announced on Tuesday that he has asked a Glynn County grand jury to consider criminal charges against Travis McMichael, 34, and his father, Gregory McMichael, 64.

The two armed men pursued Arbery for a block in a pickup truck inside the Satilla Shores community, according to a Glynn County police report.

Travis McMichael stepped out of the truck with a shotgun and confronted Arbery, according to the report.

Recently released video supports this account.

A struggle ensued for possession of the gun.

McMichael fired the shotgun three times.

Arbery, 25, stumbled to the street after the third shot and died on the scene.

Gregory McMichael told police he saw Arbery running down the street and suspected him of burglary. He said he went inside the home and called to his son, Travis.

Gregory McMichael grabbed a .357 caliber handgun and Travis McMichael took the shotgun, according to the police report. They hopped in a pickup truck and pursued Arbery, the report said.

The first 911 caller told the dispatcher at 1:09 p.m. that Arbery had stepped inside an open home under construction, then stepped back out and started running down the road, according to 911 tapes.

A second 911 caller at 1:14 p.m.: “There’s a black male running down the road,” according to 911 tapes.

In a short statement released at 10:20 p.m. Tuesday, the GBI said only that it is investigating the shooting at the request of DA Durden.

Arbery’s parents held a video press conference Wednesday morning with their respective lawyers, who called for the immediate arrests of the McMichael men, as well as one other man who they say played a role in the shooting. Attorneys Lee Merritt and Benjamin Crump also suggested the case would be better served on the federal level and treated as a hate crime.

If you'd watched the video, you'd have seen that it seems apparent that the deceased attacked Mr. McMichael and attempted to wrest the shotgun out of his hands.
 
To foment a citizens arrest, you need to have seen him commit a crime, or have probable cause.

That is what happened. The deceased was identified by the McMichaels as the supect in a burglary which was reportedly caught on a security camera. If that camera was recording, the evidence should be crucial.

You don't have the right to stop someone and question unless you are a cop.

Yes, you do, under OCGA 17 -4 -60: "A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge . If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.”

IF they thought he committed a crime, they could have followed him and called 911.

The former cop and son acted very stupidly.

Perhaps they did. Acting stupidly within the law does not render anyone liable to arrest.

That's not even close to what I said.

I pointed out that the senior McMichael is no longer a law enforcement officer.

That renders your statement either incorrect, or irrelevant and superfluous. In this instance, nobody charged a "cop".

You charge a cop that has a gun trying to get it YOU WILL BE SHOT!!! SELF DEFENSE !!!
 
Update: father and son arrested; no grand jury?

Gregory McMichael, 64, and his son Travis, 34, were taken into custody by the Georgia Bureau of Investigation and charged with aggravated assault as well as murder in the killing of Ahmaud Arbery in the town of Brunswick, the agency said in a statement.

The Feb. 23 shooting death of Arbery, 25, as he ran unarmed through the small town was captured on video by an unnamed witness in a vehicle near the scene. The video’s wide broadcast in recent days ignited outrage among activists, politicians and celebrities who saw the incident as the latest case of white perpetrators killing a black man and going unpunished.

It was not immediately clear if the two men had retained attorneys.

A district attorney appointed to handle the high-profile case after two other prosecutors recused themselves said on Wednesday he would ask a county grand jury to decide if the two men should face charges.

The men’s arrest by the GBI, one day after the agency opened an investigation into the case, appears to have sidelined any grand jury probe.

The video footage shows Arbery jogging down a narrow two-lane road and around the McMichaels’ white pickup truck, which had stopped in the right lane with its driver’s door open.

As Arbery crosses back in front of the truck, a gunshot is fired.

Arbery is then seen struggling with a man holding a long gun as a second man stands in the bed of the truck brandishing a revolver.

Two more shots are heard before Arbery stumbles and falls face down onto the asphalt.

The GBI said it was Travis McMichael who fired the fatal round.

According to a police report, Gregory McMichael, a former Glynn County police officer and district attorney’s investigator, told detectives the incident began when he spotted Arbery from his front yard “hauling ass” down the street.

McMichael told police that, because he suspected Arbery in a string of recent neighborhood break-ins, he and his son gave chase in the truck, with Gregory McMichael carrying a .357 Magnum revolver and Travis armed with a shotgun.

Gregory McMichael said Arbery began to “violently attack” his son, fighting him for the shotgun, prompting Travis to open fire.

The police report indicates the two men got into their truck and saw Arbery running.

They attempted to cut him off, but he turned around and began running in the other direction.

They continued to follow Arbery, they shouted “stop, stop, we want to talk to you.”

When they pulled up next to Arbery, Travis McMichael got out of the truck with the shotgun.

According to statements, that’s when Greg McMichael said Arbery attacked his son and the two men started fighting over the gun.

Then, Travis McMichael fired his weapon.

A video appears to have been taken from a car that was riding behind the McMichaels and traveling along the same road Arbery was running on.

In it, you see a man that's assumed to be Arbery near a white truck parked in the street.

Then, yelling can be heard, as the camera drifts out of focus.

When it comes back onto the scene, a gunshot can be heard, then a second, then the man who has been identified as Arbery can be seen struggling with a man for what appears to be a shotgun, as the camera again drifts.

You hear a third shot as the struggle continues.

The other man can be seen stepping back and Arbery stumbles forward and falls.

The black man ran around the front of the truck and bull charged the man on the OTHER SIDE of the truck and started swinging and trying to get the gun...he could have run away towards the house screaming for help

Idiot. Arbery ran around the passenger side of the car after seeing one of the gun-carrying lunkheads standing on the driver's side and watching him. He was shot within seconds of coming around again. Those two had no business trying to stop Arbery at gunpoint. Furthermore, we don't know what they said to Arbery during the episode.

He ran toward one of the gun-carrying lunkheads standing on the driver's side and watching him. Then he tried to grab the gun. Then he got shot.
