If he was going to the driver's side then why didn't he continue that way? if he was getting in on the passenger side, why did he not go to the door before stepping off the curb? Are you claiming he was trying to open the tailgate to ride in the vehicle? If the vehicle is properly parked it would be impossible to step off the curb at the back of the vehicle and then walk to the passenger door.
