If YOU hire her, yes; because if YOU hire her, you are obligated to meet all the employment requirements.

Now; if she has her own business or is an employee of a business, then the onus lies with either her or them.

Ahhh, interesting So legally I need to find out (ask) if they run their own business? The lady I use has a business card or a flyer with info that states Professional Cleaning Service with her contact info on it. It seems like she runs her own business but obviously anyone can put a brochure together.

I'm no lawyer so I cannot give you any legal advice or anything, but it doesn't sound to me like you could ever reasonably be considered this person's employer, which is probably all that matters. You are a customer, nothing more.


Edit: The more important question is why the fuck an unemployed single man is using a cleaning lady.

Haha... good question. I used to use her twice a month but have cut back to once. I saved money pretty well so I'm not in danger of going broke (yet) and still have a little bit of cash flow coming in from investments and outside of nights at the bars I don't spend all that much. At the end of the day it comes down to me being lazy and not wanting to clean so I would rather cut something else out of my budget and keep the cleaning lady. Recently she's come every six weeks so I'm cutting back even more (so to speak).

I'd keep the brochure, for a very long time.
Since she's advertising as a business, it would be the same as you finding her in the Yellow Pages.
Keep the brochure in case somewhere down the road it turns out that she isn't licensed and they try to say you did something illegal.

You make an excellent point. Realistically though what are the chances I would ever run into that outside of running for a political office?

I think if every region voted to give away a state, it would look like this:

Northeast: NJ
Mid-Atlantic: DC (you dumbasses are always saying you want to be treated like a state, now here's your chance!!)
Southeast: Florida (jealousy)
Midwest: Iowa (via compromise)
Southwest: Texas
Pacific Coast: Oregon (sorry retards)
Mt. West: Utah (its a Mormon thing)
Plains West: Oklahoma
