He is actually forbidden to take part in debate as President of the Senate. So, he would be unable to formally inform the Senate of any of that. His only role is to run the meeting and break tie votes.If Cheney wants to say he is part of Congress instead of the Executive Branch then I am sure ALL of the Senate would enjoy him SHARING all of this confidential material with them, which would be required by Law also.

I think it is more likely that he is saying that he is not an "agency".
