Trump had possession of the document. If it pertained to national defense then it is covered by the law even if it isn't classified.

The only interpretation of US 793 is it covers any document that relates to National Security that could reasonable be considered a threat to national security if revealed even if the document is not classified.

I never said it had been proven. I only said that a crime can be committed even if the documents are not classified.

Your argument seems to be that Trump could have "declassified" the sailing plans for every US Navy ship and then shared them with the Russians after leaving office and would not be guilty of a crime.

There is a protocol - and docs would be labeled that way if they were. Trump has everyone thinking he can just say "These are declassified!", and it makes it true.

Lol POTUS is the authority on declassification the only protocol necessary is him literally waving his hands over the documents and saying "poof you're declassified."

So, even if documents were found that are classified, it would be very difficult, exceedingly difficult, for a federal prosecutor to prove that Mr. Trump or any other president didn't just wave their hand over the documents and say, I now declassify you.

In order to prove a criminal case of mishandling or retaining classified information, you would also have to essentially prove a negative, that that didn't happen, that the documents were properly classified, and that President Trump took the documents in a classified condition, he mishandled them, and retained them.

That's a very difficult criminal case, given that the president has ultimate classification and declassification authority.

In an alternate universe, Trump has already been press-ganged by the younger and stronger inmates into cleaning their toilets and making their beds.

I actually think he'll be in court too much - too many jurisdictions fighting over him for the rest of his life - which might not be too much longer. What stress that mutt must be under.
