The surpeme court hasn't decided on the 2nd since Miller in 1937. And even then they sent it back to the lower court to provide further evidance. Since Miller was dead before his case even went to the SC, it got dropped in the lower court and thus never settled. Now the Parker case is up and if they choose to review it, that will give you an answer as to what the SC says on the 2nd.
