Manslaughter charge dismissed in Daniel Penny trial, jury to consider negligent homicide charge

He might have accidentally killed the POS, but there's no evidence that he intentionally "murdered" him.

If there's a civil trial, it will be interesting to see what kind of damages the plaintiffs will allege.

Loss of income? Not likely.

Loss of companionship? The guy was a raging lunatic. What kind of companionship could he have provided.

If there's a civil suit, it will be nothing more than another naked money grab by the ghetto rat families of some POS thug society is better off without anyway.

They should get what he was worth..... 0.

Penny should sue the shitbag's mother for producing that lowlife who forced him to act to begin with.
I happen to believe he did the right thing initially. He just screwed up, which is why the manslaughter charge was dropped yesterday. CNH is more appropriate, but I doubt he'll be convicted.

What was the cause of death? NYC's policies are responsible for his death... He shouldn't have been in the subway that day...

Yes, Penny obviously erred in not releasing his hold sooner. But apparently he didn't realize Neely was in such a danger.

In such a case where someone was obviously acting to protect people from a violent actor, the state should not have been so overzealous in its prosecution.

They should have charged him with the lesser crime to begin with and gone for a sentence of probation.

Which they might have done if Neely had been white, or even more likely if Neely was white and Penny was black.

But because Neely was black and Penny is white, they had to go for the harshest prosecution possible to keep a mass temper tantrum from causing all the chaos and destruction we've seen on behalf of worthless street thugs in the past.

Getting the care he was denied.
He wasn't denied care....was he? He should have been in jail... Receiving therapy/treatment through the prison programs ... He obviously should not have been out in about in public...

I'd say it's the racists who are playing the race card, if there is one being played at all.
That said, I agree with your assessment. New Yorkers have taken to the streets over stupid shit in the past.

Allowing Penny to skate opens a dangerous door. I'm sure you remember the original subway vigilante Goetz.

He was eventually convicted for the illegal handgun, but acquitted on the charges related to murder. He couldn't keep his big mouth shut though, and rode the wave of public opinion.

His bragging ultimately cost him in the civil suit. I suspect the same will happen here. Whereas a jury might not consider Penny a criminal, he was negligent in his actions.

Democrats are just upset because they are not in a position to claim him a martyr, riot and start HLM (homeless lives matter). Democrat politicians are really pissed because they will not be able to lay on the floor of Congress holding their throat for a photo op.

That is very obvious... On so many different levels... Had this been a black hero subduing a crazed white man Threatening others there would have been a parade instead of a charge and a trial...
