A military board has recommended dismissal for a Marine sergeant who criticized President Obama on his Facebook page, including allegedly putting the president's face on a "Jackass" movie poster.

The Marine Corps administrative board said after a daylong hearing late Thursday at Camp Pendleton that Sgt. Gary Stein has committed misconduct and should be dismissed.

The board also recommended that Stein be given an "other than honorable" discharge. That would mean Stein would lose his benefits and would not be allowed on any military base.

If you are in the military you do not enjoy the right of free speech.

Stein’s military defense lawyer, Capt. James Baehr, argues that the comments are protected by the First Amendment.

“How can we expect Marines to participate in citizenship if they cannot join political discussions?”

Sergeant Stein called the president “the economic and religious enemy” and advocated for Mr. Obama’s defeat in the upcoming election through the sale of NOBAMA 2012 bumper stickers on one of four websites (including Armed Forces Tea Party) that Stein operates.

The defense team also notes that Stein made these comments after hours, and not while he was on duty.
