In civil court in order to recover damages you have to prove what you lost. In these cases the RIAA has to prove the amount they lost as a result of the individual illegal downloads in order to recover.

This is civil law, US. There wouldn't be enough evidence to prove she was P2P filesharing in criminal law, so they go after her in a civil suit, which is easier. The thing about a civil suit, however, is that damages have to be inflicted for one to be filed.

"The government" aren't the people doing this anyway, Gonzo. The important thing in criminal law is that all the charges have to be proved beyond the shadow of a doubt. In civil law, it just has to be proven more likely than not.
