After doing some research I will admit I was wrong only the President or VP can invoke the 25th Amendment . and with Trump and Vance in office that is a wasted Amendment seeing neither one will invoke it .
So Trump can be nutter then a loon and he will stay in office.
It's actually the VP and the Cabinet who invoke it. The Congress can also create another body to invoke it.

Section 4 — Involuntary Transfer of Power


This is the part people mean by “invoking the 25th.”

Who can initiate it?

  • The Vice President, plus a majority of the Cabinet’s principal officers (usually the 15 department heads).
    • Alternatively, another body designated by Congress could take this role, but that’s never been created.
How it works:
  1. VP and a majority of the Cabinet send a written declaration to the President pro tempore of the Senate and the Speaker of the House, stating that the President is “unable to discharge the powers and duties of his office.”
  2. The Vice President immediately becomes Acting President.
  3. The President can contest this by sending a letter saying he’s able to resume duties.
  4. If the President disputes it, Congress must vote within 21 days:
    • It takes a two-thirds vote of both the House and Senate to keep the VP as Acting President.
    • If that threshold isn’t met, the President regains power.

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office.

Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.
