What are cops suppose to do wait till someone shoots someone and say, yup thats a real gun he just killed that 9 year old...than police can open fire?

Officer involved shootings are routinely investigated in due course. Sometimes the officers seemed to have a solid footing and sometimes not. I probably would have shot this guy too if I had been called to the scene with numerous reports of a man brandishing a gun. Anyway, mental health patient vs. cop often ends this way. Unfortunate, but raising the incompetency thresholds to open the gates of the nuthouses has consequences.
 
two issues with ANY law enforcement incident..

1) any OIS is immediately looked at as an assault on a cop which eliminates any pretense at equal protection under the laws
2) people are continually swayed to believe that cops are just citizens trying to do a hard job while they enjoy every protection afforded to the government via court decisions

it's time people wake up and realize that law enforcement are government and you MUST hold them to the same standard you would everyone else.

Bull Shit

Legally it doesn't matter if the gun was fake or not.

The persons who he pointed at "thought" it was a real gun, and it was presented as a real gun, makes u guilty of assault with a deadly weapon; a felony.

Doesn't necessarily mean you caused bodily harm or even tried to. "Assault" as a legal term can mean you just made someone feel their safety was in jeopardy by threatening them.


If I grab something that looks like a gun act like im going to shoot you with it, I can be arrested for assault with a deadly weapon, regardless of whether I shoot you and regardless of whether the thing is even a real gun or a toy. All the prosecutor has to prove is that I made the attempt, and that you believed the the threat was real and it made you feel life was in danger.


He can be charged, even if the threat wasn't something he could actualize.


The people he threatened didn't know it was fake etc. He had a object acted out and forced them to fear for their lives. This silly 'prank' fucked up his life. It's not even funny, aren't prank things that should make people laugh instead of fearing for their lives..

anyone should understand if you run from cops, point "objects" at cops ( even cellphones) you put yourself in a dangerous situation.

That doesn't mean cops are automatically allowed to shoot - but common sense means deferring to caution
and not putting yourself in a questionable situation

Yes, it ABSOLUTELY DOES! Running from the police should automatically get the death penalty. Hell, they should kill everyone who mouths off to them too. We need to start giving these heroes the respect they deserve or else!

Yeah, protect and serve means shoot on sight. Phones and shower heads are scary and people with them must die. Empty that gun in them. Then you remove a contradictory eyewitness testimony. It is whatever you and the other cops agree it is.

My State's laws consider alleging you have a deadly weapon in words or actions is the same as actually having one.

Acting like you have a deadly weapon is the same as having one under my State's laws.

Here's a novel idea. Don't act like you have it unless you want to be treated as having it.
