You can get worse discrimination than this by wandering around the internet, her "damages" are non-existant. Some guy was a racist prick, end of story.

No, an employer is not allowed to discriminate... a non-employer, in most circumstances, is allowed to disciminate. Just because a non-employer encouraged the employer to disciminate does not absolve the employer from his duty not to disciminate.
 
Sue the employer for relaying the request of a customer? They weren't being racist pricks, he was. She's just in this for the cash, rather like most people who sue.

I must be out of the loop. I never knew you could request a hospital caregiver based on race (or gender or appearance or religion, etc.).
 
If the father had asked not to be served by nurses under 5 ft 1, it would be equally silly ad still his choice. There are other nurses and does this particular woman have some kind of attachment to this kid? It's not her kid, I think she can handle the horror of not having to deal with one more squalling kid. Seems more to me that she was probably walking past, saw the sign and thought, "Jackpot, time to get one of those 10 million dollar settlements and retire" since apparently her emotional trauma can't be compensated with anything less than a seven digit paycheck.

You must think it's a slam dunk that she'll win the suit.

I'm sorry was she given a worse job? Was her pay docked? Was she in any way harmed by being assigned somewhere else? All that happened was a different nurse was given that particular job and she was moved to somebody else. I don't see how this was harmful.

In most cases I think it'd be the subject for ridicule after work, "Did you see that redneck jerkoff? He musta thought his kid would catch blackness off me."
 
To say that people dont have a right to their beliefs is to say that our Constitution doesnt say Freedom of speech. I have met lots of people in my lifetime and everyone has a right to their beliefs. Its to these beliefs that I am going to press the people here to come clean about. If you were a racist would you hire a black person as a babysitter? NO. If you were a Black Panther would you hire a white person as a babysitter? If you were a jew would you hire an islamic to babysit? If you were a Arab would you hire a jew to babysit your kids?

The point Im making here is that If you cant trust some people its best to exclude them from caring for your loved one if possible. EVERY HOSPITAL DOES IT IN ONE FORM OR ANOTHER. My grandmother was in a hospice when she started turning up with bruises all over. She wouldnt say because she feared reprisal, we got to the bottom of it and several black orderlies were fired. They were caught dropping people on purpose. My grandmother actually would shake when we were in the room and one of these black orderlies would move her.
We have freedoms. They include having our own people care for us especially when our beliefs are significantly different than the caregivers. I've heard some say that this person should have taken his child to a private hospital and pay out of pocket, WHY?? He's already paid, its part of his taxes and insurance. In the past 20 years hospitals have gone out of their way to employ people of color instead of whites. I know both nurses and doctors that say the same thing. We have a right to representation, not just in politics but in jobs. if Hospitals arent recruiting white people they need to start.

Is "dropping while black" different somehow from "dropping while white"?

I agree, she was discriminated against... But I don't believe I see any damages for her to recover.
