Obama says Police acted stupidly!

I know in Alabama if a law enforcement office asks you for ID you are required to present it.

you are only required to identify yourself IF you are detained for an investigation of the possibility that you have committed a crime, are committing a crime, or are conspiring to commit a crime. Police may not detain you for simply walking down the street minding your own business.

Identify does not mean handing over a DL either. You only have to provide a name and an address at a minimum. Now, if that can be reasonably deemed insufficient because your name is John Smith, then you can be detained at the police department until your identity can be verified.
 
being rude is not a crime. disorderly conduct is used way too often to justify an arrest because someone is easily offended by an otherwise legal action. DC laws should be wiped off the face of the earth. you do not have the right to not be offended. fuck you.

Being belligerent to a cop that is doing his/her job should most certainly get you arrested. Refusing to show an ID when a cop asks you for it while investigating a potential crime should get you arrested.

Next time you get pulled over for speeding etc... refuse to show your ID to the cop. See what happens.

Which is exactly what this case warranted. I dont think he was suggesting that cops randomly stopped people and asked for their ID.

But having had a call that someone was breaking in a house is good enough to qualify as "suspicious behavior".

two totally different situations. since the privilege of driving requires a license, if you are stopped while driving you MUST present the license. If I'm stopped walking down the street because I 'match the description' of a suspect, I am only required to give my name and address at a minimum

No, not if someone else has reported suspicious behavior as was the case with this professor.

Now that I have seen the photo of the arrest, I do find it hard to believe that the neighbor didn't recognize the professor given that it was in broad daylight.

From the photo, I also have a hard time believing racial profiling on the part of the cops given that one of the cops there was also black.

Actually, I was referring to WB's comment about presenting ID in Alabama.

I'm still on the fence with the professor's case. I'd hope my neighbors would watch out for suspicious behaviour if they knew I wasn't home, and people trying to push in a door doesn't look good.

Reasonable suspicion for Loitering is pretty easy to go with.
 
The police did act stupidly, which is why the charges were promptly dropped. I'm not saying that Gates was correct, but calling a cop a racist and acting upset within your home at police behavior is fairly well-establish first amendment protected activity.

#2 - Cops find a man inside the house and (I am thinking) evidence of a break-in.


Should they have just walked away after being told he lived there? Were they acting in a racist manner for being suspicious? (given the info they had)

That is such a bullshit excuse. When a cop is investigating a reported crime (or potential crime), that cop does not have to put up with someone who refuses to show ID, calls him a racist for doing his job, and acts belligerent towards the police. While a person would have the RIGHT to call the cop a racist or 'act upset' that does not mean that their actions are without potential consequences.

Further, the Professor is the idiot in this situation for crying racism in a case where one of the responding cops was black and for having provided nothing to support such an accusation. He demeans all of those who ARE subjected to racial profiling and discrimination.

I'd be happy to have such thugs around.

This is what cracks me up. The cops get called racist for doing their jobs. Had they not gone to investigate and it turned out it was a burglar then they would have been called racists for not responding to a burglary call at a black mans home.

Had they not acquired ID and it turned out to be a burglar, they would have been called racists for not being diligent enough in their duties because it was a black mans home.
